Pleased to share my review in @LexisNexis of the @Chartered Institute of Arbitrators (CIArb) new "Guideline on the Use of AI in Arbitration 2025".
💥 SUMMARY: The only useful discussion regarding #AI is a #practical discussion. That is because abstract AI hype causes collective fatigue and audiences switch off. I therefore welcome the Guideline which takes a commendably practical approach, all the way to providing draft agreements and procedural orders for the use of AI in #internationalarbitration. The Guideline also identifies "risks" of use. Whilst this is important, we must be careful not to overstate those risks. For example cybersecurity risks pre-date AI, and we should not reject or overregulate AI as a tool because of such legacy risks. Solution: isolate which risks are uniquely enhanced by AI, and find AI tools that keep the human lawyer in the loop as a safeguard, as the Guideline anticipates.
